1. Who we are

This website is operated by Azul Labs LLC, a New Mexico limited liability company doing business as Rafter Fan Co., with a registered address at 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, United States. Throughout this site, "we", "us" and "our" refer to Rafter Fan Co.

By visiting this site or placing an order, you agree to these Terms of Service. If you do not agree, please do not use the site.

2. Eligibility

You must be at least 18 years old, or the age of majority in your state, to place an order. By placing an order you confirm that you meet this requirement and that the information you provide is accurate.

3. Products and descriptions

We describe our products as accurately as we can, including dimensions, materials, airflow and noise figures supplied by the manufacturer. Product photographs are representative. Wood is a natural material, so grain and tone vary from one fan to the next, and screen colors vary between devices. A variation of this kind is not a defect.

We reserve the right to change or discontinue a product at any time, and to limit the quantity of any product we sell.

4. Pricing and payment

All prices are shown in US dollars and exclude sales tax, which is calculated at checkout where applicable. Prices may change at any time before you place an order, but the price you are charged is the price shown at the moment you complete checkout.

We reserve the right to refuse or cancel an order, including after it has been placed, where a product has been listed at an obviously incorrect price, where we suspect fraud, or where the order cannot be fulfilled. If we cancel an order you have paid for, we refund you in full.

5. Orders and acceptance

Your order is an offer to buy. Our acceptance happens when we send you a shipping confirmation, not when you receive the order confirmation email. Until that point either party may cancel.

6. Shipping, returns and refunds

Delivery times, shipping costs and duties are set out in our Shipping Policy. Returns, refunds and cancellations are set out in our Returns and Refunds policy. Both form part of these Terms.

7. Installation and safety

Ceiling fans are electrical fixtures and must be installed in accordance with the supplied instructions, your local electrical code and, where required, by a qualified electrician. A ceiling fan must be mounted to an electrical box rated to carry a fan, not to a standard lighting box. We are not liable for injury, property damage or product failure resulting from improper installation, unsuitable mounting, modification of the product, or use other than as intended.

8. Warranty

Our products are covered by the manufacturer's warranty against defects in materials and workmanship. To make a claim, email support@rafterfan.com with your order number and a description of the fault, together with photographs where the fault is visible. The warranty does not cover normal wear, damage from improper installation or use, or any product that has been modified.

9. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or relating to any product or order is limited to the amount you paid for that order. We are not liable for indirect, incidental or consequential damages. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Intellectual property

The content of this site, including text, photographs, graphics and the Rafter Fan Co. name and logo, is our property or used under license, and may not be reproduced without our written permission.

11. Accuracy of the site

We work to keep the site accurate and up to date, but we do not warrant that it is free of errors. Where information on the site is out of date, we are under no obligation to update it except as required by law.

12. Governing law

These Terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in New Mexico.

13. Changes to these Terms

We may update these Terms at any time. The version in force is the one published on this page at the time you place your order. Material changes take effect when posted.
